POTTERY STUDIO PARTICIPANT AGREEMENT, ASSUMPTION OF RISK, RELEASE OF LIABILITY & POLICIES

PROGRAM DESCRIPTION & VOLUNTARY PARTICIPATION

Enrolling in pottery classes and activities at Totah Studio may include wheel throwing, hand-building, trimming, glazing, and kiln firing. Programs may include single-day workshops, multi-week courses, or other formats.

Participation is voluntary and participants may withdraw at any time.

EXPRESS ASSUMPTION OF RISK

Participation in pottery activities involves inherent risks, hazards, and dangers that may result in injury or illness. These risks include, but are not limited to:

  • Burns from kilns, hot surfaces, or heated materials

  • Cuts, punctures, or abrasions from tools or equipment

  • Slips, trips, and falls due to wet floors, clay, or studio conditions

  • Exposure to dust, including silica, which may pose respiratory risks

  • Lifting, repetitive motion, or strain injuries

  • Exposure to glazes, chemicals, or materials that may cause allergic or skin reactions

Participants acknowledge these risks may result from their own actions, the actions of others, or the condition of the premises.

All participants knowingly and voluntarily assume all such risks, both known and unknown, even if arising from the negligence of Totah Studio or its staff, to the fullest extent permitted by California law.

RELEASE OF LIABILITY

In consideration for being allowed to participate, participants hereby release and discharge Totah Studio, its owners, employees, instructors, agents, and contractors from any and all liability for personal injury, illness, death, or property damage arising out of or related to participation in studio activities. This release applies to claims based on ordinary negligence but does not apply to gross negligence, reckless conduct, or intentional misconduct, which cannot be waived under California law.

INDEMNIFICATION

Participants agree to indemnify and hold harmless Totah Studio and its representatives from any claims, damages, liabilities, or expenses (including reasonable attorneys’ fees) arising out of participation or failure to follow studio rules.

HEALTH & SAFETY AGREEMENT

Particpants agree to:

  • Follow all instructions provided by instructors and staff

  • Use tools, equipment, and materials only as directed

  • Wear appropriate attire (including closed-toe shoes; secure loose clothing and hair)

  • Remove and protect jewelry and valuables that may be damaged or cause injury

  • Refrain from participating under the influence of drugs or alcohol

  • Notify staff of any relevant medical conditions, allergies, or limitations

CANCELLATIONS & REFUNDS

Due to limited class sizes, all registrations are subject to the following policy: Cancellations made within 48 hours of booking are eligible for a full refund. Request must be submitted in writing to hello@totahstudio.com. After 48 hours from the time of booking, workshop fees are non-refundable.

If unable to attend, participants may request their spot be offered to our waitlist. If we are able to fill your space, we may issue a studio credit or refund. This is not guaranteed and is handled at the discretion of Totah Studio.

Once a program has begun, no refunds or credits will be issued.

Medical Exceptions: We understand that serious medical issues can arise. Refunds or partial credits after a program has started may be considered in cases where a participant is physically unable to attend. A note from a licensed medical provider is required. Any accommodation is at the discretion of Totah Studio.

Missed classes are non-refundable and are not eligible for make-ups or credits unless otherwise stated.

Class registrations are non-transferable unless approved in writing.

By registering, participants acknowledge that spot is reserved specifically for them and that last-minute cancellations are difficult to fill.

Totah Studio reserves the right to cancel or reschedule classes due to low enrollment or other circumstances.

Unsafe, disruptive, or inappropriate behavior will result in removal from class without refund.

ARTWORK POLICY

Participants understand and agree that

  • Pottery is an inherently unpredictable process, and pieces may crack, warp, or break during drying or firing.

  • Accidents do sometimes occur.

  • Totah Studio does not guarantee results or finished products

  • Finished work must be picked up within 2 weeks after notification

  • Items not picked up within that timeframe may be discarded or recycled at the studio’s discretion

PERSONAL PROPERTY

Totah Studio is not responsible for lost, stolen, or damaged personal belongings.

Participants agree to be responsible for damage to studio equipment or property caused by my misuse or failure to follow instructions.

PHOTO & MEDIA RELEASE

Totah Studio may use photos or videos of me/my child for marketing and promotional purposes. Participants will submit a written notice if they do not want their photos used.

EMERGENCY MEDICAL AUTHORIZATION

In the event of an emergency Totah Studio may obtain medical treatment for participants, who will be responsible for any associated costs.

GOVERNING LAW

This Agreement shall be governed by and interpreted in accordance with the laws of the State of California.

SEVERABILITY

If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

ACKNOWLEDGMENT OF UNDERSTANDING

All participants must have carefully read this Agreement and fully understand its terms. Participants understand they are giving up substantial legal rights, including the right to sue for ordinary negligence, and agree to these above terms and voluntarily.
